A baby born to diplomats, who are here legally, is not a US citizen. Yet a baby born to an illegal or visitor is? The Constitution is clear, an obscure one off targeted ruling is what has been misinterpreted and then never challenged for additional clarification. There hasn't even been a case where parents renouncing citizenship as an issue has been brought to the Supreme Court. This has never been a big issue because numbers were low, but now it's become an issue that will brought to the Court.
This is, of course, distinguishable. A diplomat is here specifically still under the jurisdiction of the country he/she is representing in an official capacity. They are excluded from being subject to US laws while acting in their official capacity, absent some very rare exceptions. An illegal is subject to US laws while present.
